EU Trade Mark Registration

If your business is expanding into the European Union, your brand protection needs to reflect where you intend to trade. An EU trade mark is a different right from a UK trade mark, so the filing plan should consider both markets where relevant.

Panoramix IP helps you plan EU trade mark protection and coordinates the relevant work through trusted European agents. You have an IP team helping to connect the European application with your wider UK, US and international brand strategy.

Choose the territory before the application

An EU trade mark can provide protection across EU member states through the EUIPO system. It does not cover the UK. A UK business can apply for an EU trade mark, but owning a UK registration does not automatically create EU protection for a new application.

We discuss where you sell, where you plan to launch and how the brand is likely to develop. The aim is to choose a filing approach that fits those plans. EU-wide protection may be relevant, while particular national filings or a wider international strategy may also need consideration.

Prepare the brand and application details

  • The mark: identify the name, logo or other sign you want to protect and how the business uses or plans to use it.
  • The applicant: confirm the person or company intended to own the application, including its correct legal details.
  • The activities: describe the goods and services offered under the mark and the business plans relevant to the application.
  • Existing rights: provide any related applications, registrations, search results or known concerns involving other brands.
  • The timetable: tell us about launch dates, earlier filings or correspondence that may affect the next step.

Consider availability and conflicts

A name being available as a company name or domain is not the same as clearance for trade mark purposes. Earlier trade marks and other relevant rights can affect the risks associated with a proposed brand. Searching before filing can help identify matters that deserve closer attention.

We discuss the appropriate clearance work and explain the issues identified within its scope. Search results inform a decision; they do not guarantee that an application will be accepted or that no one will object. If a potential conflict appears, the next step depends on the facts and the commercial options available.

Describe the right goods and services

The application needs to identify what the mark is intended to cover. Goods and services are organised into classes, but the wording within those classes matters as well. A useful brief describes the actual business activities instead of relying only on a class number.

We help turn that brief into a proposed specification with the relevant European input. Before filing, we discuss the mark, applicant details, proposed coverage and scope of work with you. This is also the point to raise likely changes in product range or business model so they can be considered.

How we coordinate EU filing support

  1. Discuss the markets and brand. We establish your objectives, current rights and any immediate deadline.
  2. Agree the work. We discuss searches, application preparation, European representation and the proposed scope and costs before instruction.
  3. Prepare the application. We coordinate with trusted European agents on the relevant EUIPO work and confirm the proposed filing details with you.
  4. Address the application stages. Examination questions or an opposition may require advice and a separate response; the scope of that work is discussed as it arises.
  5. Plan ongoing management. After registration, consider records, renewal responsibilities, watching and any later ownership or commercial changes.

European representation and a clear point of coordination

EUIPO representation rules are relevant to applicants outside the European Economic Area. Panoramix coordinates EUIPO work through trusted European agents; this service is not a claim that every member of our UK team is directly entitled to represent applicants before EUIPO.

We explain the roles involved and how the proposed work fits your broader portfolio. Our existing UK and US trade mark services can be considered alongside the European application, with the territory and scope of each instruction kept clear.

Your questions answered

Will a new EU trade mark registration protect my brand in the UK?

No. EU trade mark protection covers EU member states. UK protection is considered separately, so tell us if the business trades or plans to trade in both territories.

Can a UK company own an EU trade mark?

Yes. A UK company can apply to own an EU trade mark. The application and any proceedings must meet the relevant requirements, including representation where required.

Does filing mean the mark is registered?

No. An application is subject to examination and may face opposition. We can discuss those stages and any work needed if an issue arises; registration and a particular outcome cannot be guaranteed.

What will the work cost?

The proposed mark, goods and services, searches and required support affect the work involved. We discuss the scope and costs before instruction rather than treating every EU application as the same matter.
