What Is a USPTO Office Action?

A USPTO office action is an official communication issued by an examining attorney at the United States Patent and Trademark Office.

It identifies an issue with your trade mark application that must be addressed before your application can progress towards registration.

This might involve providing additional information, amending your application or responding to an objection concerning the eligibility of your trade mark.

Receiving an office action does not necessarily mean your trade mark application has been rejected.

Many objections can be addressed through an appropriate response. However, understanding the issues raised and responding within the required deadline is essential to keeping your application on track.

How Long Do You Have to Respond to a USPTO Office Action?

For most US trade mark applications, you have three months from the date the office action is issued to submit a response.

An additional three-month extension may be available, subject to the applicable USPTO fee.

If you miss the deadline, your application may be abandoned. In some circumstances, it may be possible to petition to revive an abandoned application, although additional fees and requirements apply.

Not sure when your response is due?

Your response deadline should be identified in your office action. Contact us and we'll confirm the relevant deadline and advise on your next steps.

USPTO Office Action Responses: Services and Fixed Fees

Our experts at Panoramix IP can review your office action and advise whether an extension is available.

What Are My Chances of Overcoming a Section 2(d) Likelihood of Confusion Refusal?

This depends on the circumstances of your application, including the similarities between the marks, the goods and services involved and the nature of the earlier registration.
