FAQs

Someone has registered a domain using my brand — what can I do?

You often have good options, especially if you hold a trade mark. Routes include a complaint under a domain dispute process (such as Nominet’s DRS for .uk domains or the UDRP for .com and others), a direct approach or letter, or negotiation to recover or cancel the domain. We assess the strongest route and handle the complaint for you.

What is cybersquatting, and is it illegal?

Cybersquatting is registering a domain that matches someone else’s brand in bad faith – often to sell it back at a profit or to divert traffic. While it isn’t a criminal offence in itself, dispute procedures and trade mark law let rights holders recover or cancel such domains. We can act where a domain has been registered abusively against your brand. Learn more about cybersquatting in our recent blog.

How does the UDRP / Nominet DRS process work?

These are relatively quick, administrative alternatives to court for resolving domain disputes. Broadly, you must show the domain is identical or confusingly similar to your rights, that the holder has no legitimate interest in it, and that it was registered in bad faith. If you succeed, the domain is transferred to you or cancelled. We prepare and run these complaints.

Can I recover a domain without going to court?

Usually, yes. Most brand-related domain disputes are resolved through the administrative processes above or by negotiation, without litigation. Court is a backstop for complex cases. We aim for the quickest, most cost-effective route to getting your domain back or taken down.
