FAQs

What counts as a counterfeit?

A counterfeit is a product that carries a mark identical or almost identical to a registered trade mark, applied without the owner’s permission – typically designed to pass the goods off as genuine. Related problems, such as copied product designs or packaging, may not be strict counterfeits but can be tackled through design right, copyright and passing off. We help you identify which rights apply.

Do I need a registered trade mark to take action?

A registered trade mark makes enforcement faster, cheaper and more certain, and is usually required for customs recordals and many marketplace programmes. Without one you may still have options through passing off or copyright, but they are generally harder to rely on. If you do not yet have registered protection, we can advise on securing it as a priority.

How do marketplace takedowns work?

Most major platforms operate notice-and-takedown programmes that allow rights holders to report infringing listings. We prepare and submit the notices, manage escalations and, where available, enrol you in brand protection programmes such as Amazon Brand Registry. Consistent monitoring alongside takedowns keeps listings from simply reappearing under new sellers.

Can counterfeit goods be stopped at the UK border?

Yes. By filing an Application for Action with HMRC, customs officers can detain suspected counterfeit goods entering the UK. We prepare the application, keep it up to date and liaise with customs when goods are detained. Equivalent recordals are available in the EU and many other territories.

What is a test purchase and why does it matter?

A test purchase involves discreetly buying a suspected counterfeit so it can be examined and preserved as evidence. Done correctly, with a documented chain of custody, it can be crucial to enforcement and any later court proceedings. We carry out and record test purchases in a way that is compliant with the Civil Procedure Rules.

Do I have to go to court to stop counterfeiters?

Often not. Many matters are resolved through monitoring, takedowns, customs action and cease and desist correspondence backed by undertakings. Litigation and injunctions are available where the scale or persistence of the problem justifies it, but we always look for the most proportionate and cost-effective route first.

How much does anti-counterfeiting work cost?

It depends entirely on the scale of the problem and the strategy you choose – a handful of marketplace takedowns is very different from investigating an overseas manufacturer. We will always give you a clear estimate and a proportionate plan before any work begins. Contact us for a tailored quote.
