Copyright protects original works – including literary, artistic, musical and software works – automatically from the moment they are created, with no need for registration. That makes it a powerful right, but proving ownership, subsistence and copying requires care.

Receiving a copyright claim can be alarming, particularly where the allegation is exaggerated or the other side’s ownership is unclear. A measured, well-advised response is almost always better than an immediate concession or an ill-judged fight.

FAQs

Do I need to register copyright to sue for infringement?

No. In the UK copyright arises automatically when a qualifying original work is created and recorded, and there is no register to join. The practical challenge is proving you own the work and when it was created, so keeping dated records, drafts and contracts is valuable. We can help you put that evidence in order.

How do I prove someone has copied my work?

You generally need to show that your work is original, that copyright subsists, that you own it, and that the other party copied a substantial part – which can be a qualitative rather than purely quantitative test. Access to your work plus close similarity is often key evidence. We assess the strength of that picture before you commit to action.

What can I claim if my copyright has been infringed?

Remedies can include an injunction to stop further copyright infringement, damages or an account of the infringer’s profits, delivery up or destruction of infringing items, and in some cases additional damages for flagrant infringement. We advise on which remedies are realistic and worthwhile in your case.

Which court hears copyright cases?

Many copyright disputes are well suited to the Intellectual Property Enterprise Court (IPEC), which has capped recoverable costs and a streamlined procedure that makes it accessible for smaller and medium-sized claims. Larger or more complex cases may proceed in the High Court. We advise on the most appropriate and proportionate forum.

Someone has sent me a copyright claim - what should I do?

Do not ignore it, but do not rush to concede either. Preserve relevant material, avoid further use of the disputed work if that risk is material, and take advice before responding. We can quickly assess whether the claim is well founded and help you respond in a way that protects your position.

Can copyright disputes be settled without going to court?

Yes, and most are. Pre-action correspondence, negotiation, mediation and licensing frequently resolve matters without a trial. Litigation remains available where settlement is not possible or where an injunction is needed urgently, but we always weigh the commercial cost and benefit first.

How much does copyright litigation cost?

It varies widely depending on the complexity of the dispute, the court involved and how far the matter runs. IPEC’s costs regime helps keep exposure predictable for many claims.
