Amazon Brand Registry: Trade Mark Support | Panoramix IP

Amazon Brand Registry

Amazon Brand Registry gives brand owners the tools to protect their listings and stand out – enhanced content, more control over your product pages, and stronger protection against counterfeiters and hijackers. But to enrol, Amazon needs proof that you own your brand. In practice, that means a trade mark.

That’s where we come in. Panoramix IP files trade marks directly in the UK, EU and – unusually for a UK firm – the US, at fixed, published fees. We get you the registration Amazon needs, without the mark-ups and delays of routing US work through a separate firm.

Need advice? We offer a free 45-minute consultation to discuss your requirements and explain how we can offer support.

Amazon Brand Registry Requirements

To enrol in Brand Registry, you generally need an active registered trade mark, or a pending application, from an accepted government trade mark office that matches the marketplace you sell in. It needs to be a word mark (your brand name) or a design mark that includes text, and your branding needs to be consistent across your trade mark, your products and your Amazon presence.

How We Help You Enrol With Amazon

• We clear your brand. A search first, so you file a name that’s actually free to protect – before you build sales around it.

• We file directly, in the right market. UK, EU or US trade mark filing to match where you sell – US handled in-house, not passed to an associate.

• We keep it plain and fixed-price. You’ll know the cost up front, and we’ll explain each step in plain English.

• We help you protect it afterwards. Once registered, we can help you monitor and enforce your brand against copycats – on Amazon and beyond.

FAQs

Do I need a trade mark for Amazon Brand Registry?

Yes. To enrol in Amazon Brand Registry, you generally need an active registered trade mark or an eligible pending trade mark application for your brand. The trade mark must be a word mark or a design mark containing words, letters or numbers, and the brand name used in your application should match your trade mark record.

If you do not yet have a trade mark, Panoramix IP can file your trade mark application in the UK, EU or US and help you put the protection in place that you need for Brand Registry.

Can I apply for Amazon Brand Registry while my trade mark is still pending?

Amazon currently allows eligible brands to apply for Brand Registry using certain pending trade mark applications, rather than always having to wait until registration is complete. You will need the application number issued by the relevant trade mark office and must meet Amazon’s other eligibility requirements.

Because Amazon’s rules and supported trade mark offices can change, it is worth checking the requirements for the marketplace you intend to use before filing. Panoramix IP can help you choose the right jurisdiction and file your trade mark accordingly.

Should I register a UK, EU or US trade mark for Amazon Brand Registry?

The right trade mark depends on where your business operates and where you intend to sell. If the UK is your main market, a UK trade mark may be the natural starting point. Businesses selling across the EU or US may also want corresponding protection in those territories.

Panoramix IP files trade marks directly in the UK, EU and US, allowing us to build an international brand protection strategy around the Amazon marketplaces and wider commercial markets that matter to your business.

What happens if my Amazon brand name is already trade marked?

An existing identical or similar trade mark can create problems both for your own trade mark application and for the long-term use of your brand. That is why carrying out a clearance search before filing is important, particularly if you have already invested in Amazon listings, packaging and stock.

We can search for conflicting rights before filing and advise whether your proposed brand is likely to be available. If a conflict already exists, our trade mark specialists can explain the risks and your options before you commit further money to the name.

Does Amazon Brand Registry stop other sellers copying my products?

Brand Registry gives eligible brand owners access to additional Amazon tools designed to help protect their brand and listings, but registration alone does not eliminate infringement. A strong underlying trade mark portfolio remains important if counterfeiters, listing hijackers or copycat sellers appear.

Panoramix IP can support you beyond registration through brand monitoring and trade mark watching and anti-counterfeiting services, helping you identify and respond to unauthorised use of your brand both on Amazon and elsewhere.

How long does it take to get a trade mark for Amazon Brand Registry?

The timescale depends on the trade mark office, whether any objections are raised and whether another party opposes the application. However, because Amazon currently accepts certain pending trade mark applications, eligible sellers may not always need to wait for the trade mark to reach full registration before applying for Brand Registry.

We can advise on the quickest appropriate filing route for your business and handle the trade mark application from filing through to registration.

Does my Amazon brand name have to match my trade mark exactly?

Yes, consistency is important. Amazon states that the trade mark text should match the brand name entered in your Brand Registry application. If you are relying on an image-based mark containing words, letters or numbers, Amazon may also require the image used during enrolment to match the official trade mark record.

It is therefore worth deciding how you intend to use your brand commercially before filing. We can help you choose an appropriate trade mark filing strategy so the application reflects the brand customers will actually see on Amazon and your products.

Can I use one trade mark for Amazon Brand Registry in several countries?

Amazon operates Brand Registry through a global account, but trade mark rights themselves are territorial. Amazon recommends adding trade marks from the relevant country-based trade mark offices for the Amazon stores in which you want to sell and protect your brand.

If you are expanding across the UK, EU and US, Panoramix IP can coordinate your international trade mark protection so your Amazon presence and wider commercial activity are supported by the appropriate registrations.

Who should own the trade mark used for Amazon Brand Registry?

The trade mark should be owned by the person or business that genuinely owns the brand. Amazon requires the trade mark owner to enrol the brand, although additional authorised users can subsequently be added to the Brand Registry account.

Getting ownership right at the filing stage is important, particularly where a business has several founders, trading companies or related entities. Panoramix IP can advise on ownership when filing the trade mark and assist with transferring IP if an existing registration is held by the wrong entity.

Can Panoramix IP help me register my trade mark for Amazon Brand Registry?

Yes. We can search your proposed brand, advise on the appropriate trade mark classes and file your application directly in the UK, EU or US depending on where you sell and plan to grow.

Unlike many UK firms, Panoramix IP can handle US trade mark work directly rather than routing the application through a separate US associate. We also offer fixed, published fees and can continue to support you after registration with trade mark protection, monitoring and enforcement.

If you are unsure what you need, you can also book a free IP clinic to talk through your Amazon brand and trade mark options.
