What is patent pending?
The term “patent pending” is a legal designation used to inform the public that an application for a patent has been filed with a government patent office, such as the UKIPO in the United Kingdom or the USPTO in the United States, but the patent has not yet been officially granted. It serves as a warning to competitors and the public that a legal protection process is underway, and if the patent is eventually issued, the owner may have the right to sue for infringement from the date the patent is granted. While other terms such as “protected by patent” are often used, the correct legal term is patent pending.
